Terms of Service

      Short version: Use Gramigo lawfully and respectfully. Don't abuse the platform or other users. We can suspend accounts that violate these terms.
    

1. Acceptance of Terms

By downloading, installing, or using the Gramigo mobile application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (16 in the EEA) to use Gramigo. By creating an account you represent that you meet this age requirement and that all information you provide is accurate.

3. Account Registration

You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
You must notify us immediately at help@getgramigo.com if you suspect unauthorised access.
You may not create an account on behalf of another person without their consent.

4. License to Use the App

Subject to these Terms, Gramigo grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, solely for personal, non-commercial purposes.

5. User Content

You retain ownership of content you submit ("User Content"), including meal photos and posts. By submitting User Content you grant Gramigo a worldwide, royalty-free, sublicensable licence to use, reproduce, and display it solely to operate and improve the Service.

You represent that your User Content does not infringe any third-party rights and complies with these Terms.

6. Acceptable Use

You agree not to:

Post content that is illegal, harmful, harassing, defamatory, or discriminatory.
Impersonate any person or entity.
Attempt to gain unauthorised access to the Service or other users' accounts.
Use the Service for any commercial purpose without our written consent.
Reverse engineer, decompile, or disassemble any part of the App.
Use automated means (bots, scrapers) to access the Service.
Upload content that contains malware or harmful code.

7. Health Disclaimer

Gramigo provides nutritional estimates for informational purposes only. The macro calculations and AI-generated content are not medical or dietary advice. Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition.

8. Intellectual Property

All rights, title, and interest in the Service (including the Gramigo name, mascots, logo, software, and design) are owned by Gramigo or its licensors. Nothing in these Terms transfers any intellectual property rights to you beyond the limited licence in Section 4.

9. Third-Party Services

The App may integrate with third-party services (e.g., the App Store, analytics providers). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their practices.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRAMIGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) CAD $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold Gramigo and its officers, directors, employees, and agents harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at our discretion, with or without notice, if we believe you have violated these Terms. You may delete your account at any time through the App settings. Upon termination, your licence to use the App ends immediately.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts located in Toronto, Ontario.

15. Changes to These Terms

We may modify these Terms at any time. We will provide at least 14 days' notice of material changes via in-app notification or email. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
